Attorneys: Join Our Network

A qualified Maine bankruptcy attorney should try to solve your problems - not make them worse.

If your finances are nonexistent and you are not able to pay your bills you should hire a Maine bankruptcy attorney - not a divorce or patent lawyer. The more knowledge your Maine bankruptcy attorney possesses the better it may be for your future.

You shouldn't attempt to do this yourself.

Debt liquidation may be too complex to handle on your own. Whether you need to file under Chapter 7 or Chapter 13, you may need an experienced Maine bankruptcy attorney who understands all facets of the U.S. Bankruptcy Code plus the exemptions you are entitled to under state exemption laws. Debt consolidation and liquidation handled incorrectly may dramatically effect your entire future. You shouldn't trust your health to just any doctor so why should you trust your entire financial future to just any Maine bankruptcy attorney.

This may be a big step for anyone, but it could be the first chapter in a happier life, Money may not buy happiness, but it may sure help when you have one less thing to worry about.

Get a fresh start when you file under Chapter 7 or 13

The most important advantage to filing under Chapter 7 or 13 is that you may be able to obtain a fresh financial start. Consumers who file for Chapter 7 may be forgiven (discharged from) most unsecured debts. A secured debt is one in which the creditor is entitled to collect by seizing and selling certain assets of the debtor if payments are missed, such as a home mortgage or car loan. With those two major exceptions, most consumer debts are unsecured. You may be able to keep (that is, exempt) many of your assets, although state laws vary widely in defining which assets you may keep.

As soon as your petition is filed, there is by law an automatic stay, which prohibits most collection activity. If a creditor continues to try to collect the debt, the creditor may be cited for contempt of court or ordered to pay damages. The stay applies even to the loan that you may have obtained to buy your car. If you continue to make payments, it is unlikely that your creditor should do anything. However, if you miss payments your creditor may probably petition to have the stay lifted in order either to repossess the car or to renegotiate the loan.
